What the official record says

Section 2695.8 defines a comparable automobile as the same manufacturer, same or newer model year, same model type, similar body type, and similar options and mileage. A newer model year is used only when there are not enough same-year comparables. The rule requires a retail listing in the local market area within 90 calendar days of the final offer, vehicle and seller identification, and itemized supported adjustments. The consumer guide also says settlements include applicable taxes, license, and transfer fees.

California’s consumer mediation program may apply to some disputes, but it excludes commercial auto coverage and third-party liability claims.
